CredAsiti Terms of Service

Welcome to CredAsiti. These Terms of Service ("Terms") form a binding agreement between you ("User", "you", "your") and CredAsiti Inc. ("CredAsiti", "we", "us", "our"), a Delaware company. By accessing or using the CredAsiti Platform—including our mobile application, website, and related services—you agree to these Terms. If you do not agree, discontinue use immediately.

1. Introduction

CredAsiti helps users manage credit card bill deadlines, receive helpful alerts, and when eligible, access a Payment Rescue Service to avoid late fees. These Terms outline your rights and obligations when using the CredAsiti Platform.

2. Definitions

  • Platform: The CredAsiti mobile app, website, services, and APIs.
  • Payment Rescue Service: A process through which CredAsiti may facilitate a credit card bill payment on your behalf to help avoid a late fee.
  • Personal Data: Information that identifies you as defined under applicable U.S. privacy laws.
  • Third-Party Service Providers: Integrated partners such as Plaid, banks, card networks, payment processors, and SMS providers.
  • Eligible Transaction: A credit card bill payment request that meets CredAsiti's criteria for the Payment Rescue Service.

3. Eligibility and User Requirements

You must be at least 18 years old, reside in the United States, and have the capacity to enter into a legally binding agreement. The Platform is for personal, non-commercial use. You affirm that all information you provide is truthful, accurate, and complete.

4. Account Creation & Verification

Registration may require your mobile number and/or email address. You authorize us to send one-time passcodes (OTPs) or use other authentication methods. Keep your credentials confidential and notify us immediately of unauthorized access. You are responsible for all activity conducted under your account.

5. Description of Services

CredAsiti may offer: (i) credit card bill reminders; (ii) the Payment Rescue Service to help avoid late fees (fees apply); (iii) card account overview dashboards; (iv) financial insights and alerts; (v) other optional future features such as rewards or offers. CredAsiti does not extend credit, issue loans, or make credit decisions.

6. Fees, Charges & Billing Terms

CredAsiti may charge a service fee when facilitating a Payment Rescue. All fees are disclosed before you confirm a transaction. By authorizing the Payment Rescue, you agree to pay the service fee. Fees are final and non-refundable except as required by law. We may adjust fee schedules with prior notice.

7. Payment Rescue Service Terms

CredAsiti monitors upcoming and overdue credit card bills. If an Eligible Transaction is identified, CredAsiti may offer to facilitate a payment. Upon your authorization, we initiate the payment via integrated processors or card rails and charge you the principal plus any disclosed service fee. CredAsiti is not a bank or lender; prevention of late fees or credit score impact is not guaranteed. Eligibility, limits, and risk checks apply, and we may decline any request at our discretion.

8. User Obligations & Responsibilities

You agree to use the Platform lawfully, avoid fraudulent activity, keep your information current, and ensure funds are available to repay amounts owed for Payment Rescue transactions. Non-payment may result in account suspension and collection remedies.

9. Communication Consent (SMS, Push & Email)

By registering, you consent to receive OTPs, account updates, reminders, and service notifications. Message and data rates may apply. Reply STOP to opt out of SMS or HELP for assistance. Opting out of SMS does not affect other communication channels.

SMS Privacy Requirement:

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Sharing with subcontractors that support the Service (for example, customer support providers) is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

10. Third-Party Services & Bank Connections

You may connect accounts through third-party providers such as Plaid. By doing so, you authorize access to and transmission of your financial data to facilitate the Service. Your use of third-party services is governed by their respective agreements, and CredAsiti is not responsible for their actions.

11. Data Access via Aggregators (Plaid)

By linking accounts through Plaid (or similar aggregators), you acknowledge that the aggregator may collect your credentials and financial data. CredAsiti may receive balances, transactions, due-date metadata, and identifiers/tokens to deliver Platform features. Usage is governed by these Terms, our Privacy Policy, and the aggregator's own disclosures.

12. Intellectual Property

All content, software, and technology on the Platform are owned by CredAsiti or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial purposes. Reverse engineering or creating derivative works is prohibited except as required by law.

13. Rewards, Offers & Future Benefits

Optional perks, rewards, referrals, or promotional offers—if made available—will be governed by separate program terms within the app. CredAsiti may modify or discontinue such programs at any time.

14. Disclaimers

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee prevention of late fees, finance charges, or credit score impacts. Data may be delayed or inaccurate depending on third-party sources.

15. Limitation of Liability

To the maximum extent permitted by law, CredAsiti is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits or data. Our aggregate liability will not exceed the fees you paid to CredAsiti in the prior three (3) months.

16. E-Sign Consent & Electronic Communications

You consent to receive electronic communications, disclosures, and records. Electronic signatures and acknowledgements have the same legal effect as paper signatures. Keep your contact information current so we can reach you.

17. Payment Authorizations; ACH/Card Disclosures

By authorizing a Payment Rescue, you confirm you are authorized to use the selected funding source and authorize debits (and, if needed, credits) for the transaction amount plus disclosed fees. Payments may be routed via ACH, card networks, or other payment rails. Timing is not guaranteed. If a payment fails or is returned, you remain responsible for the outstanding balance, and we may retry as permitted by law and network rules.

18. Prohibited Activities

  • Engaging in unlawful or fraudulent activity.
  • Misleading financial institutions or circumventing contractual obligations.
  • Interfering with or compromising the Platform's security.
  • Unauthorized access, scraping, resale, or framing of the Platform.
  • Abusive behavior toward CredAsiti personnel or other users.

19. Suspension & Termination

We may suspend or terminate access for suspected fraud, non-payment, policy violations, or legal requirements. You may close your account at any time. Provisions that logically survive termination will remain in effect.

20. Dispute Resolution; Arbitration; Class Action Waiver

Contact support within 30 days of an issue so we can attempt informal resolution. If unresolved, disputes are settled by binding arbitration under the AAA Consumer Arbitration Rules, seated in Delaware (or virtually). Class actions are waived; claims must be brought individually. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@credasiti.com.

21. Governing Law & Venue

Delaware law governs these Terms. Subject to the arbitration agreement, any permitted court actions must be brought in state or federal courts located in Delaware.

22. Changes to the Service or Terms

We may modify the Platform or these Terms with notice for material changes. Your continued use after the effective date constitutes acceptance of the updated Terms.

23. Assignment

You may not assign these Terms without our consent. CredAsiti may assign these Terms in connection with a merger, acquisition, or other corporate transaction.

24. Severability; Waiver

If any provision is unenforceable, it will be interpreted to best reflect the original intent while remaining enforceable. Failure to enforce a provision does not constitute a waiver.

25. Entire Agreement

These Terms and the CredAsiti Privacy Policy constitute the entire agreement between you and CredAsiti and supersede all prior understandings.
